REGULATIONS OF THE LIBRARY OF AREA INGEGNERIA "F. GASPARINI”  

 

Art. 1 – Purpose

  1. The Area Ingegneria Library, established by law DG / 2013/216 on 14.02.2013, henceforth referred to as the Library, acquires and manages the book and documentary assets in the sector of scientific relevance of the following Departments: Department of Chemical Engineering, Department of Materials and Industrial Production; Departments of Civil, Building and Environmental Engineering; Department of Electrical Engineering and Information Technologies; Department of Industrial Engineering; Department of Structural Engineering and Architecture; in order to provide services for teaching and research under the rules contained in the Regulations of the Library System and the University Centre for Libraries, hereinafter referred to as the SBA Regulation, issued on the 14th February 2013 by DR 2013/569 14.02.2013 and which can be referred to for everything that is not specified.

Art. 2 - Users

  1. Pursuant to art. 2 of the SBA Regulation, the Library, while ensuring the availability of its collections to those interested, gives priority to the various categories of internal users (of the department and other departments), each with different access and provision and use of services.

  2. Internal users of the area:

    • Staff belonging to the departments which, pursuant to art. 15, c. 2 of the SBA Regulations, have indicated the Library as their reference Library, including anyone who performs teaching or research activities, even temporarily;
    • Students regularly enrolled in a degree course in a department that indicates the Library as its reference Library;
    • PhD students whose PhD office is in a department that has indicated the Library as its own reference Library, including PhD offices from other universities, which are in a consortium with the Academia Fridericiana.
    • Staff, students, PhD students in the engineering area who have a direct and official dependency or study relationship with one of the SHARE inter-university agreement signatories for the integration of library and documentary services.
      The Convention is signed with:

    3. Internal users of other departments are:

    • Staff belonging to departments which, pursuant to art. 15, c. 2 of the SBA Regulation, did not indicate the Library as its own reference Library, including anyone who performs teaching or research activities, even temporarily;
    • regularly enrolled students from departments that have not designated the Library as their reference Library;
    • PhD students whose PhD positions are in a department that has not indicated the Library as its own reference Library, including PhD offices from other universities, which are in a consortium with the Academia Fridericiana;
    • technical-administrative and managerial staff of the University not affiliated with any department.
    • staff, students, non-engineering doctoral students who have a direct and official dependency or study relationship with one of the signatories of the Inter-university Convention (SHARE) for the integration of library and documentary services.
      The Convention is signed with:

    4. Esternal users are:

    • students, teaching and technical-administrative staff who belong to scientific and cultural institutions with which the University of Naples Federico II has stipulated special agreements or memoranda of understanding with;
    • Anyone who, for reasons of study or research, asks to be accredited as a user, and submits a motivated authorization request, for approval by the director. If the application is accepted, the director defines the period of time for which the user can use the services. The director also establishes which services the user can access.

    5. The Library can issue users with a card to access services.

Art. 3 - Authorities

  1. The Library authorities are:
    • the Director;
    • the Library Commission.

Art. 4 - The Director of the Library and his duties

  1. The director is a technical-administrative staff member within the Library area, in the EP or D category and is appointed by the Director General of the University, with the CAB president’s approval.
  2. The director carries out the following tasks:
    • in implementation of the guidelines established by the CAB Managing Committee, the director  promotes and controls the planning activity, both of content and structure, and in particular, the widest enrichment and related updating of the material for all the disciplinary areas pertaining to the Library, according to the plan approved by the Library Commission;
    • oversees, with administrative responsibility, the activity of the Library, the management of assets and economic resources assigned, the management of personnel and the organization of services;
    • represents the Library in connection with other University Structures and Bodies;
    • prepares the annual report on the activity carried out to be transmitted to the CAB and to the Library Commission;
    • submits staff and funding requests to the CAB Management Committee;
    • proposes the penalties imposed on users of the Library who are responsible for serious violations of the Library's Rules of Operation to the Library Commission.

Art. 5 – The Library Commission

  1. The Library Commission consists of:
    • up to a maximum of 9 representatives of the teaching and research staff, designated by the Departments that have indicated the Library as their reference Library, according to criteria of proportionality to the number of the members in the Department;
    • the director of the Library;
    • a representative of the administrative technical staff in service at the Library, elected by a simple majority and secret ballot by the staff assembly called by the Library Director 10 days previously.
  2. The composition of the Library Commission, whose members remain in office for three years and can be renamed only once, is ratified by a resolution of the CAB Managing Committee.
  3. The Commission, first convened by the Library Director, elects its President internally and approves its own statute of rules.
  4. In accordance with the guidelines established by the Library System, the Commission:
    • establishes the general criteria for the use of equipment and premises and funds allocated by the CAB;
    • approves the collection development plan;
    • approves the Library Operating Rules, in accordance with the provisions of the Framework Regulation, as per art. 14 of the SBA Regulation, and the Service Charter;
    • advances development proposals on the activities of the Library;
    • deliberates on the acceptance of any donations, or assignments of bibliographic material, exceeding 100 volumes;
    • deliberates on the proposals for inventory discharge;
    • approves requests for funding and staff to the CAB Managing committee;
    • approves the annual activity plan and expresses its opinion on the report of the results achieved;
    • approves proposals for contracts, agreements and collaborations with public and private bodies presented by the Library Director or by its members, verifying the implementation and congruence with the institutional purposes of the Library;
    • on the proposal of the Library Director it approves sanctions against any users of the Library responsible for serious violations of the Library Rules.

Art. 6 - Services

  1. Pursuant to art. 19 of the SBA Regulations, the Library, carries out the following activities and provides the following services:
    • acquisition, inventory and descriptive and semantic cataloging of all the bibliographic-documental material acquired, using the University's automated systems;
    • opens to users, with a public time schedule, of at least 35 hours per week;
    • consultation and reading of the library and documentary material held;
    • loan of allowed material;
    • interlibrary loan and document delivery;
    • reproduction of documents available to users, in compliance with the regulations in force concerning the protection of copyright;
    • assistance in retrieving information;
    • positions for access to the University's electronic resources;
  2. All services are provided in time slots and duration, suitable to meet the requests of users. In particular, the services indicated in points c) to g).

Art. 7 - Access and consultation on site

  1. aAccess to the Library is allowed to users defined in art. 2 of this Regulation.
  2. The Library allows access with your own books or other documentary material.
  3. Where the seats are not sufficient to guarantee the needs of all users, the Director of the Library has the right to reserve up to 90% of the available seats for inhouse users.
  4. All resources that make up the bibliographic and documentary heritage published, regardless of their format, are accessible for consultation, without prejudice to the provisions of current legislation on copyright and privacy protection. The consultation of some documents may be regulated by specific contracts and therefore limited to internal users.
  5. The books kept in the cupboards (whose location contains "AR"), the periodicals placed in the vault (from before the last decade) or in progress (placed in the Office) and particular electronic resources are available from 9.00 to 13.00

Art. 8 – Loans

  1. Loans are made exclusively with the automated procedures adopted by the SBA.
  2. Loans are personal and non-transferable; users may be asked to show a certificate of enrollment, an identity card or an equivalent document.
  3. All internal users of the area and internal users of other areas are admitted to the loan, as well as, if authorized by the Director of the Library, external users.
  4. Students must be up to date with their fees.
  5. The borrower is responsible for the integrity of the material and its return within the deadline.
  6. Upon return, the user can request a receipt confirming the return.
  7. The user is required to promptly communicate changes in address, telephone and e-mail.
  8. The maximum number of borrowed volumes is two units.
  9. The duration of a loan is set at 15 days, after which the material must be returned; if there are no requests from other users, the loan can be renewed, before the deadline, for a further 15 days. At the time of renewal request, the user must show the book.
  10. The Library Director, for the needs of the library itself, reserves the right to request the repayment of loans at any time.

Art. 9 - Materials excluded from the loan

1. Some materials cannot be loaned, unless otherwise provided for by the director:

    • material not yet inventoried or catalogued;
    • reference and frequent use volumes: encyclopedias, dictionaries, codices, directories, bibliographies;
    • in print and antique manuscript material, rare and autographed volumes, and those of particular historical and artistic value;
    • thesis;
    • microfilm, microfiches;
    • works received on interlibrary loan for which the lending institution prescribes in house use;
    • material for which the donor or testator has expressly prohibited loans;
    • flip works;
    • periodicals;
    • books in precarious states of preservation;
    • volumes for internal use for library services;
    • documents in electronic format:
    • all material that, although not included in the previous points, is not marked for loan in the University catalogue.

Art. 10 - Obligations and sanctions related to the loans
 
The Library periodically verifies the successful return in due time of loaned materials.

  1. Failure to return materials received on loan, within the established deadline, will result in suspension from Library services in proportion to the extent of the delay.
  2. In case of failure to return materials received on loan, after 5 days from the third and last reminder, the Director of the Library will proceed to report the individual to the institutional disciplinary bodies for embezzlement.
  3. Users in receipt of material on loan must check its integrity and state of conservation and immediately report any failures and faults encountered, to the staff in order to avoid liability.
  4. Users that, having borrowed materials, return them damaged or lose them, are obliged to refund the damage by purchasing a new copy or, if it is no longer on the market, by purchasing bibliographic material of the same value on the basis of indication of the Library. The user will be suspended from loans until compensation is made.
  5. At the request of a user, the Library Director is required to issue a certificate, required for admission to the final exam, which confirms the successful return of all library and documentary materials borrowed from the libraries, as recorded in the management software; at the same time the user will be excluded from the borrowing procedure.

Art. 11 – Interlibrary loan

  1. Internal users who do not have a reference departmental library are allowed to use the interlibrary loan service.
  2. Through the interlibrary loan service, users can request documents not held by the Library or the other University Libraries from libraries based outside the province of Naples.
  3. Documents received for interlibrary loan can only be consulted at the Library.
  4. Libraries whose headquarters are outside the province can request documents owned by the Library for their users.
  5. The service is subject to the early repayment of the living expenses that the Library will sustain.

 Art. 12 – Supplying document copies

  1. Internal area users are allowed to use the document copy delivery service.
  2. Users can request from libraries whose headquarters is outside the province of Naples, copies of articles not owned by the Library or the other University Libraries.
  3. Libraries whose headquarters are outside the province of Naples can request their users’ documents held by the Library.
  4. The Library performs the service exclusively with other Libraries / Institutions / Institutions that commit themselves to a free reciprocal regime.

Art. 13 – Reproductions

  1. Photocopies and reproductions by other technical means of articles or parts of volumes, are permitted for personal use, in compliance with the current legislation on copyright (Law 633/1941 and subsequent amendments and additions).
  2. Historical collections, materials published prior to 1900 and valuable materials, materials in precarious conditions of conservation or otherwise susceptible to damage, are excluded from photocopying. These materials can only be reproduced photographically.
  3. It is necessary to send an authorization request to the Library Director for photographic and filmographic, and reproductions by any other technical means, of cultural assets owned by library. The same rules apply to filming and reproducing rooms that house libraries.
  4. Reproduction costs are charged to the user.

Art. 14 - Bibliographic information and research assistance

  1. The Library assists its users with bibliographic research and in finding information resources.
  2. With the research assistance service (reference) the Library guarantees personalized assistance to user research projects, offering strategic support for finding and assessing resources relevant to the specific research.
  3. The Library may organize courses to teach the use of bibliographic research tools and techniques and for remote information and bibliographic sources.

Art. 15 – Internet Access

  1. The Library recognizes the use of electronic information to satisfy the information and educational needs of the academic community.
  2. The Library offers its users priority access to the University's catalogue, to electronic databases and periodicals, as well as to the Internet as an additional information tool to traditional sources. Internet in the library is therefore to be used as a source of information for research, study and documentation purposes.
  3. The responsibility of the information present on the Internet is the responsibility of every single producer: it is up to the user to critically examine the quality of the information found. The Library is not responsible for the contents offered.
  4. The staff of the Library guarantees basic assistance to users, compatibly with other service needs.

Art. 16 – Obligations and penalties for Internet access

  1. The Internet cannot be used for purposes prohibited by current legislation.
  2. The user is directly responsible, civilly and criminally, according to the laws in force, for the use made of the Internet service. The Library reserves the right to report any user to the competent authorities for illegal activities carried out. The user is obliged to compensate the damage caused to equipment, software or configurations.
  3. The user is responsible for the violation of protected access, copyright and user licenses.
  4. It is forbidden to alter data entered by others or perform operations that affect or compromise the regular operation of the network or restrict its use and performance for other users.
  5. It is forbidden to alter, remove or damage the software and hardware configurations of the Library computers.
  6. It is forbidden to upload files over the network (upload), use instant messaging and chat (IRC), or virtual calls.
  7. The obligations set out in paragraphs 1 to 4 of this article also apply to users who connect to the Internet with their personal laptops.
  8. The violation of the obligations referred to in these Regulations, may involve respectively:
    • session interruption;
    • suspension or exclusion from access to the service;
    • report.

Art 17 - Purchase proposals

  1. Users can propose the purchase of bibliographic material.
  2. Suggestions will be accepted subject to availability in the financial statements and according to the development criteria of the collections established by the Director.

Art 18 - Obligations for staff members

  1. Staff are obliged to make themselves available and easily recognizable by users during service hours.
  2. Staff are obliged to intervene directly or on user's notice in order to enforce the rules set forth in these Regulations, taking the appropriate measures, in consultation with the Library Management.
  3. The staff undertakes to respect the right to privacy of users: all user personal data will be exclusively managed for internal purposes within the procedure for which they were released; the Library also guarantees each user access to information concerning them, and in particular to those relating to the status of loans in progress.

Art 19 - Obligations of users

  1. Every user who uses the services of the Library must observe the rules of good and correct behaviour to staff and other users. In particular, the respect for the rules of cohabitation suitable for the attendance of a place of study is mandatory, so that users are required to:
    • maintain appropriate behaviour and respectful silence;
    • not be absent from the Library keeping the reading room occupied for more than 30 minutes;
    • not take up more than one seat;
    • not use IT tools for purposes other than bibliographic consultation;
    • not damage furniture and furnishings;
    • not study in groups;
    • not use mobile phones;
    • not smoke (the prohibition includes electronic cigarettes);
    • not introduce food or drink;
    • not damage the documentary material of the library with underlines or signs.

Art 20 - Sanctions

  1. Defaulting users, especially if they repeatedly contravene their obligations to the Library or to the rules of these Regulations, may be temporarily or definitively excluded from the Library, without prejudice to any civil or criminal liability.
  2. In particular, those who are guilty of stealing material that turns out to be the library's property will be excluded on a permanent basis and referred to the judicial authority.
  3. In the event of repeated behaviour that does not comply with the rules set out above, the Library Director is obliged to promptly inform the institutional disciplinary bodies. 

Art 21 – Charter of services and complaints

  1. The Library establishes principles and rules in the relationship with the users who use its services in the Charter of service quality.
  2. The Charter is a communication and information tool that allows users to know the services offered, to verify the commitments undertaken, to express their own evaluations.
  3. Users have the right to claim for failure to comply with the commitments made in the Charter by the Library.
  4. The complaint must be forwarded to the Library Director and must contain general information, address and availability, can be presented verbally, in writing or sent by fax or e-mail (oral or telephone complaints must be confirmed in writing). Anonymous complaints will not be considered. The complaint will be given a reasoned reply as soon as possible and in any case not later than fifteen days. At the same time procedures will be launched to eliminate the established causes of any inefficiency.
